Randomized control trials (RCTs) are the gold standard for estimating causal effects, but often use samples that are non-representative of the actual population of interest. We propose a reweighting method for estimating population average treatment effects in settings with noncompliance. Simulations show the proposed compliance-adjusted population estimator outperforms its unadjusted counterpart when compliance is relatively low and can be predicted by observed covariates. We apply the method to evaluate the effect of Medicaid coverage on health care use for a target (...) population of adults who may benefit from expansions to the Medicaid program. We draw RCT data from the Oregon Health Insurance Experiment, where less than one-third of those randomly selected to receive Medicaid benefits actually enrolled. (shrink)

It has been 40 years since the seminal papers on pharmacy's status as a profession sparked debate about the pharmacist's role in health care, yet the questions they raised are just as poignant today as they were then. Questions about whether pharmacists are the experts when it comes to drug therapy information can be answered practically by assessing the perception of pharmacists' obligations to patients as being dependent on or independent of physicians' responsibilities. Both options have important implications for pharmacy's (...) status as a profession, the value that pharmacists can add to health care, and a pharmacist's right to deny a patient emergency contraception. BackgroundNo standard method exists to assess how many consults a healthcare ethics consultation (HCEC) service should perform. To address this, we developed a method to estimate the volume of HCEC services based on a mixed-methods approach that included a systematic review and survey data on the volume of consult services requested.MethodsOur investigation included a systematic review of studies that reported the volume of HCEC services that were requested from 2000 to 2017, institutional surveys, and statistical analyses that estimated the volume (...) of HCEC services that were adjusted to the size of the hospitals in the survey and to population acuity.ResultsWe contacted the authors of 19 studies that met our inclusion criteria; 17 authors responded to the institutional survey and five provided annualized data points. We found that standard methods of reporting the volume of HCEC services led to inaccuracies in estimating the growth of HCEC services over time. To rectify this, we proposed two means to estimate volume based on either the service goals of HCEC services or hospital size and acuity.DiscussionThe statistical limitations of our study highlight the need to standardize the sharing and reporting of data in clinical ethics. Future work should further standardize methods of HCEC quality assessment using measures similar to those we describe. (shrink)

We systematically examined the content of the websites of 46 agencies that buy and sell human eggs to understand how they market themselves to both donors and recipients. We found that these websites use marketing techniques that obscure the realities of egg donation, presenting egg donation as a mutually beneficial and fulfilling experience. Sites emphasize egg donors' emotional fulfillment and address recipients' anxieties by stressing the ability to find the perfect “fit” or “match”, suiting recipients’“preferences”/“desires”, and even designing/customizing a child. Agencies attempt to create a sense of connection between the recipients and donors by reporting donors' personal characteristics — e.g., interests/hobbies, traits, mood/temperament, and self-reported childhood behavior/memories. Sites present donors as caring/generous and smart/successful/beautiful. These data, the first to examine several key aspects of egg donation agency websites, reveal critical aspects of how these companies communicate to prospective donors and recipients, raising several ethical concerns. Websites frame information in ways that may bias consumers, making emotional appeals that may distract from appropriate risk/benefit assessments and obscure the ethical challenges of egg donation. These data highlight needs for improved practices, adherence to guidelines, and consideration of enhanced guidelines or policy. (shrink)

The Yogārṇava is a Sanskrit compendium on yoga that has not been published, translated or even mentioned in secondary literature on yoga. Citations attributed to it occur in several premodern commentaries and compendiums on yoga, and a few published library catalogues report manuscripts of a work on yoga called the Yogārṇava. This article presents the results of the first academic study of the text. It has attempted to answer basic questions, such as the work’s provenance and textual sources. Izmed marksističnih mislecev njegove generacije ni bil nihče v tolikšni meri tarča očitkov teoreticizma in političnega odpadništva kot prav Althusser, kar Rancière opisuje kot »althusserjansko zanikanje političnih učinkov«. Članek predstavi pregled zgodovinskih teženj in nasprotnih teženj, ki jih najdemo v Althusserjevih spisih (...) med »dolgimi šestdesetimi«, in trdi, da ne smemo podcenjevati vloge teorije in teoretikov v prid osvobajajočih praks maja 1968, ampak moramo Althusserjev domnevni teoreticizem misliti v kontekstu politično motiviranih teoretskih bojev in rivalstev, ki so določali »politiko njegovega časa«. Public health law has focused primarily on combatting stigma through laws targeting discrimination based on attributes, when the reach of stigma extends far beyond mere appearances. By exploring the lived experience of stigmatized individuals, policy makers might more deeply understand public health problems, more appropriately create health policies, and more effectively promote positive health behaviors. Efforts to address stigma must focus on all aspects of stigma to be effective.

Illness narratives invite practitioners to understand how biomedical and traditional health information is incorporated, integrated, or otherwise internalized into a patient’s own sense of self and social identity. Such narratives also reveal cultural values, underlying patterns in society, and the overall life context of the narrator. Most illness narratives have been examined from the perspective of European-derived genres and literary theory, even though theorists from other parts of the globe have developed locally relevant literary theories. Further, illness narratives typically examine (...) only the experience of illness through acute or chronic suffering (and potential recovery). The advent of biomedical disease prevention methods like post- and pre-exposure prophylaxis (PEP and PrEP) for HIV, which require daily pill consumption or regular injections, complicates the notion of an illness narrative by including illness prevention in narrative accounts. This paper has two aims. First, we aim to rectify the Eurocentrism of existing illness narrative theory by incorporating insights from African literary theorists; second, we complicate the category by examining prevention narratives as a subset of illness narratives. We do this by investigating several narratives of HIV prevention from informants enrolled in an HIV prevention trial in Kenya and Uganda in 2022. (shrink)

Prevladujoča domneva, da je Rossla motivirala lastna ambicioznost, ki naj bi bila pogubna za usodo komune in nasprotujoča njenim revolucionarnim egalitarnim načelom, se na (...) podlagi obstoječih dokazov zdi poenostavljena. Elided VPs and their antecedent VPs can mismatch in voice, with passive VPs being elided under apparent identity with active antecedent VPs, and vice versa. Such voice mismatches are not allowed in any other kind of ellipsis, such as sluicing and other clausal ellipses. These latter facts indicate that the identity relation in ellipsis is sensitive to syntactic form, not merely to semantic form. The VP-ellipsis facts fall into place if the head that determines voice is external to the phrase (...) being elided, here argued to be v P; such an account can only be framed in approaches that allow for the separation of syntactic features from the heads on which they are morphologically realized. Alternatives to this syntactic, articulated view of ellipsis and voice either undergenerate or overgenerate. (shrink)

Libertarians often bill their theory as an alternative to both the traditional Left and Right. _The Routledge Handbook of Libertarianism_ helps readers fully examine this alternative, without preaching it to them, exploring the contours of libertarian thinking on justice, institutions, interpersonal ethics, government, and political economy. The 31 chapters--all written specifically for this volume--are organized into five parts. In this paper, I elaborate a Derridean deconstruction of law through the lens of Lacanian psychoanalysis. Derrida only focuses on jurisprudential law enforcement in his famous ‘Force of Law’ lecture, leaving corporeal law enforcement untouched. In turn, I explore the irresolvable conceptual tensions within corporeal law enforcement from the standpoints of (a) individuals rationalizing their obedience to law enforcement and (b) the legal system rationalizing its circumscription of acceptable law enforcement. To support my analysis, I examine landmark court cases and (...) their deleterious effects on accountability for law enforcers. In particular, I track the progression from the legal standard of ‘shock of conscience’ (i.e., established by Rochin v. California (1952)) to that of ‘objective reasonableness’ (i.e., established by Graham v. Connor (1989)), which reinforces the legal protections for and libidinal features of police brutality. In this sense, I seek to clarify the dimensions of the libidinal economy belonging to policy brutality, namely its components of sadism and superegoic enjoyment. (shrink)

According to the Social Security Administration, 98% of minor children are eligible to receive survivors benefits if a working parent dies. However, the eligibility of children born, and even conceived, after a working parent dies is less clear. In recent years, the Social Security Administration has received more than 100 applications for survivors benefits filed on behalf of children conceived after a parent's death, and one such case, Astrue v. Capato, was heard by the U.S. Supreme Court in 2012. In (...) that case, whether the child is eligible to inherit under state intestacy law was accepted as a reasonable — and is a common — approach for determining eligibility for Social Security survivors benefits. This paper examines the ‘doctrine of reportage’—a particular application of the Reynolds qualified privilege defence to defamation recognized by the House of Lords in Reynolds v Times Newspapers Ltd. The doctrine of reportage provides protection for the neutral reporting (republication) of defamatory allegations made by others in the context of a dispute or controversy of public interest. It is argued in this paper, however, that this emerging defence is doctrinally distinct from the privilege recognized in Reynolds and that its jurisprudential (...) basis needs to be reconsidered. Moreover, the development of the defence under the guise of Reynolds privilege has led to confusion, both by courts and by commentators, as to its potential breadth. It is suggested that the public interest justifications underpinning the reportage defence need to be explicitly re-examined by the courts in order to define its proper scope. Following an examination of these public interest justifications, it is argued that a broad interpretation of the defence should be rejected. (shrink)

It is traditionally the role of the storyteller to create a believable narrative, with the reader investing attention into believing the story while the critic dissects the results to ascertain whether the (...) magic works. As Wallace Stevens put it, "we orchestrate a whole history and then imprison ourselves in the score, as if someone else had written it." 1 In the author's note to the second edition (1962) of Wise Blood (1949) Flannery O'Connor makes the point that her novel is a comic novel, yet its comedy does not lessen the depth of understanding it offers concerning the complexity of freedom. 2 The obsession with fate and destiny that swamps her characters, leads the reader into a gothic nightmare where humans in their attempt to re-create themselves dig themselves further into the graves of their dead relatives. For O'Connor free will does not mean one will but many wills conflicting in one man, and she explains the integrity of the central character of Wise Blood, Hazel Motes, as stemming from his vigorous attempts to rid himself of the "ragged figure who moves from tree to tree in the back of his mind."This figure is the Jesus of his grandfather, and it is also the religious preoccupation of the Deep South. Destiny has shaped his features and his character in the mold of his grandfather, and whomever he meets believes he too is a preacher. After establishing the Church Without Christ, like many sons attempting to shake off their origin, Hazel Motes realizes that his new way of behaving is in some sense being controlled [End Page 211] by his past and that he must shake off all vestiges to possess freedom. One might argue that, by eventually blinding himself, Hazel Motes is behaving as a soul who has given into the temptation of purgation, as if this is destiny. But it can be argued that this act is going against destiny, as it is an act that is perhaps trying to persuade God of something, despite the Oedipal connotations.Questioned by his landlady why he blinded himself he says to pay, and when asked to pay for what, he replies it does not matter what. Mrs. Flood is frightened of death, particularly death being one long blind existence, and Hazel Motes is a reminder to her of her destiny. This can be read as a judgment on life also. Yet she eventually decides to take care of him, for both altruistic and materialistic reasons, believing that his widow would inherit his war pension. Mrs. Flood, her name evocative of apocalyptic occurrences and Old Testament punishment, is a critic of the text; the text in this instance is nothing written but rather Motes himself. It seems that Hazel Motes, his name a reference to taking the mote out of one's own eye before you try and take the splinter out of another's, is punishing himself for his previous denial of Christ and for his sins, such as fornication, as with Mrs. Watts the prostitute and Sabbath Hawks, and murder, but also something more primal.After trying desperately to break the curse of his biological inheritance, his wise blood, just like the character Enoch Emery, it forces him to once again take on roles that deny him freedom. Hazel Motes may seem to a contemporary reader as a caricature, the mad preacher/antipreacher of the American South, but as V. S. Pritchett puts it, Hazel Motes is "entirely real" (p. viii). His self-blinding is part of his further alienation from the world, the world he has come back to after the "Great War." O'Connor shows how this watershed in human history was so devastating, Motes's new theology entirely rational. Dobbs v. Jackson Women’s Health continues a trajectory of U.S. Supreme Court jurisprudence that undermines the normative foundation of public health — the idea that the state is obligated to provide a robust set of supports for healthcare services and the underlying social determinants of health. Dobbs furthers a longstanding ideology of individual responsibility in public health, neglecting collective responsibility for better health outcomes. Such an ideology on individual responsibility not only enables a shrinking of public health infrastructure for reproductive (...) health, it facilitates the rise of reproductive coercion and a criminal legal response to pregnancy and abortion. This commentary situates Dobbs in the context of a long historical shift in public health that increasingly places burdens on individuals for their own reproductive health care, moving away from the possibility of a robust state public health infrastructure. W. V. Quine famously argues that though all knowledge is empirical, mathematics is entrenched relative to physics and the special sciences. Further, entrenchment accounts for the necessity of mathematics relative to these other disciplines. Michael Friedman challenges Quine’s view by appealing to historicism, the thesis that the nature of science is illuminated by taking into account its historical development. Friedman argues on historicist grounds that mathematical claims serve as principles constitutive of languages within which empirical claims in physics and the (...) special sciences can be formulated and tested, where these mathematical claims are themselves not empirical but conventional. For Friedman, their conventional, constitutive status accounts for the necessity of mathematics relative to these other disciplines. Here I evaluate Friedman’s challenge to Quine and Quine’s likely response. I then show that though we have reason to find Friedman’s challenge successful, his positive project requires further development before we can endorse it. (shrink)

Mechanisms of selective attention exert a powerful influence on visual perception. We examined whether attentional selection is necessary for generation of the vivid colours experienced by individuals with grapheme-colour synaesthesia. Twelve synaesthetes and matched controls viewed rapid serial displays of nonsense characters within which were embedded an oriented grating (T1) and a letter-prime (T2), forming a modified attentional blink (AB) task. At the end of the stream a coloured probe appeared that was either congruent or incongruent with the synaesthetic colour (...) elicited by the letter-prime. When the prime was attended, synaesthetes showed a reliable effect of prime-probe congruency. In contrast, when the prime appeared at 350 ms following T1 (during the AB), the congruency effect was eliminated. This is a work in Kantian conceptual geography. It explores issues in analytic epistemology, philosophy of language, and metaphysics by appealing to theses drawn from Immanuel Kant's Critique of Pure Reason.

For quite some time, cognitive science has offered philosophy an opportunity to address central problems with an arsenal of relevant theories and empirical data. However, even among those naturalistically inclined, it has been hard to find a universally accepted way to do so. In this article, we offer a case study of how cognitive-science input can elucidate an epistemological issue that has caused extensive debate. We explore Jason Stanley’s idea of the practical grasp of a propositional truth and present (...) naturalistic arguments against his reductive approach to knowledge. We argue that a plausible interpretation of cognitive-science input concerning knowledge—even if one accepts that knowledge how is partly propositional—must involve an element of knowing how to act correctly upon the proposition; and this element of knowing how to act correctly cannot itself be propositional. In this dissertation, I explore the work of Donald Davidson, reveal an inconsistency in it, and resolve that inconsistency in a way that complements a debate in philosophy of science. In Part One, I explicate Davidson's extensional account of meaning; though not defending Davidson from all objections, I nonetheless present his seemingly disparate views as a coherent whole. In Part Two, I explicate Davidson's views on the dualism between conceptual schemes and empirical content, isolating four seemingly different arguments that Davidson (...) makes against the dualism; I demonstrate that, though the arguments fail, each is ultimately meant to rely on his account of meaning. ;In Part Three, I show that Davidson's extensional account of meaning gives rise to the analytic-synthetic distinction, while simultaneously needing to reject it. I then propose a resolution to Davidson's dilemma. Rather than treating interpretation of meaning as continuous with the holistic enterprise of science, as Quine treats translation, one should treat it as conceptually prior to science, as Kant treats epistemology. Nonetheless I recognize four reasons why Davidson himself would reject doing so. I therefore propose a view called 'transcendental semantics', based on Davidson's, that accepts my resolution. Further, transcendental semantics, like Kant's own transcendental idealism, posits a single conceptual scheme; nonetheless Kant's is concerned with Newtonian physics, transcendental semantics' with interpretation. ;Finally, in Part Four, I show how positing such a scheme allows transcendental semantics to complement a promising neo-Carnapian account of theory confirmation in science proposed by Michael Friedman. Scientists are first and foremost interpreters, a fact that allows transcendental semantics to help Friedman establish the possibility of rational continuity through scientific revolutions. In fact, transcendental semantics, by complementing Friedman's project, reunites two of Carnap's own concerns, philosophy of language and philosophy of science. I conclude that philosophy of language without philosophy of science is empty , while philosophy of science without philosophy of language is blind. (shrink)

A period of exposure to trains of simultaneous but spatially offset auditory and visual stimuli can induce a temporary shift in the perception of sound location. This phenomenon, known as the 'ventriloquist aftereffect', reflects a realignment of auditory and visual spatial representations such that they approach perceptual alignment despite their physical spatial discordance. Such dynamic changes to sensory representations are likely to underlie the brain's ability to accommodate inter-sensory discordance produced by sensory errors (particularly in sound localization) and variability in (...) sensory transduction. It is currently unknown, however, whether these plastic changes induced by adaptation to spatially disparate inputs occurs automatically or whether they are dependent on selectively attending to the visual or auditory stimuli. Here, we demonstrate that robust auditory spatial aftereffects can be induced even in the presence of a competing visual stimulus. Importantly, we found that when attention is directed to the competing stimuli, the pattern of aftereffects is altered. This paper is a companion piece to my earlier paper “Fallibilism and Concessive Knowledge Attributions”. There are two intuitive charges against fallibilism. One is that it countenances the truth (and presumably acceptability) of utterances of sentences such as “I know that Bush is a Republican, though it might be that he is not a Republican”. The second is that it countenances the truth (and presumably acceptability) of utterances of sentences such as “I know that Bush is a Republican, even though (...) I’m not certain that he is”, or “I know that Bush it a Republican, even though it isn’t certain that he is.” In “Fallibilism and Concessive Knowledge Attributions”, I argue that fallibilism in epistemology does not countenance the truth of utterances of sentences such as “I know that Bush is a Republican, though it might be that he is not a Republican”. In this paper, I argue that there are independent reasons for thinking that utterances of sentences such as “I know that Bush is a Republican, though I’m not certain that he is” and “I know that Bush is a Republican, though it’s not certain that he is” are unassertible. More specifically, I argue that these are simply instances of Moore’s Paradox, such as “Dogs bark, but I don’t know that they do.” The right account of Moore’s Paradox does not involve the falsehood of the semantic content of the relevant utterances, but rather their pragmatic unacceptability. So the anti-fallibilist intuitions turn out to have pragmatic, rather than semantic import, and therefore do not tell against the truth of fallibilism. Fallibilism in epistemology is often thought to be theoretically desirable, but intuitively problematic. My purpose with these two papers is to show that fallibilism is not intuitively problematic. Evidentialists maintain that epistemic justification is strictly a function of the evidence one has at the moment of belief. I argue here, on the basis of two kinds of cases, that the possession of good evidence is an insuflicient basis for justification. I go on to propose a modification of evidentialism according to which justification sometimes requires intellectually virtuous agency. The discussion thereby underscores an important point of contact between evidentialism and the more recent enterprise of virtue epistemology.

Philosophers have long been tempted by the idea that objects and properties are abstractions from the facts. But how is this abstraction supposed to go? If the objects and properties aren't 'already' there, how do the facts give rise to them? Jason Turner develops and defends a novel answer to this question: The facts are arranged in a quasi-geometric 'logical space', and objects and properties arise from different quasi-geometric structures in this space.

This chapter seeks clarification into how Marion understands “desire,” especially in The Erotic Phenomenon. Philosophies of “objectivity” have lost sight of love and its uniquely supporting evidences, and desire plays a number of roles in restoring to love the “dignity of a concept,” in its contribution to forming selfhood and “individualization,” and in its establishing the paradoxical bases of the erotic reduction and “eroticization.” Since he claims in La Rigueur des Choses that “The Erotic Phenomenon logically completes the phenomenology of (...) the gift and the saturated phenomenon,” it is necessary to conceive of how and to what degree. The erotic reduction demands that one bracket oneself and return to the Ursprung of intuition by asking the important question “can I be the first to love?” This chapter initiates an application of these findings on the manifold of desire back onto Marion’s understanding of “the gift” and his phenomenology of givenness. How might the erotic reduction and the reduction to givenness interrelate? Might love and desire be modes or “capacities” of alteration of one’s experience within intuition? Many philosophers, in discussing supererogation, maintain that supererogatory actions must be done for the benefit of others. In this paper I argue that there can be instances of self-regarding supererogatory actions. That is, there are cases in which the primary (or sole) intended beneficiary of a supererogatory action is the agent herself, and she need not be acting out of a concern for morality or moral rules. In such cases the agent still acts suitably 'beyond the call of duty', and (...) in a morally praiseworthy fashion. (shrink)

Most people seem to believe that it is wrong to cause needless suffering and death to non-human animals, and yet most people also contribute to the needless suffering and death of a great many animals. If speciesism is understood as a psychological prejudice—the tendency of an individual human agent to disregard the interests of animals—then this fact is extremely difficult to explain. I argue that once speciesism is understood structurally—as a matter of injustice rather than a matter of interpersonal wrongdoing (...) or individual prejudice—the project of explaining how so many humans are implicated in animal suffering becomes much more tractable. Drawing on the work of feminist theorists such as Sally Haslanger and Catharine MacKinnon, I suggest a way of reconceiving the question of the moral status of animals as a political question about the construction of animals and animality through our social, cultural, legal, and linguistic practices. The concept of wisdom is largely ignored by contemporary philosophers. But given recent movements in the fields of ethics and epistemology, the time is ripe for a return to this concept. This article lays some groundwork for further philosophical work in ethics and epistemology on wisdom. Its focus is the distinction between practical wisdom and theoretical wisdom or between phronesis and sophia . Several accounts of this distinction are considered and rejected. A more plausible, but also considerably more complex, account (...) is offered. The discussion sheds light on the relation between practical wisdom and theoretical wisdom, and on the positive character of each. (shrink)

I argue that the simple foreknowledge view, according to which God knows at some time t 1 what an agent S will do at t 2 , is incompatible with human free will. I criticize two arguments in favor of the thesis that the simple foreknowledge view is consistent with human freedom, and conclude that, even if divine foreknowledge does not causally compel human action, foreknowledge is nevertheless relevantly similar to other cases in which human freedom is undermined.
